Just a few weeks ago, there were changes from the FMCSA due to COVID-19. The FMCSA has granted a three-month waiver from certain pre-employment testing requirements applicable to employers of drivers subject to 49 CFR part 382.
This waiver is effective from June 5, 2020, and ends on September 30, 2020. Under this waiver, the time frame has been extended out to 90 days and would permit employers to forego pre-employment testing for drivers who have participated in a controlled substance testing program that meets requirements of Part 382 within the previous 90 days of hire or rehire.
In cases of furloughed commercial drivers, the FMCSA believes that this will be an effective return to their passenger and property transportation functions. In addition, the FMCSA has determined that the waiver is likely to maintain the same level of safety if the waiver was not in place.
